تبرع بالدم .. في عيد الميلاد المجيد










انطلقت اليوم حملة تبرع بالدم في بغداد لبث الحياة من جديد لكافة الجرحى تفجيرات يوم الخميس الاسود حيث نظم هذه الحملة الاستاذ محمد الربيعي عضو مجلس محافظة بغداد وبالتعاون مع المدونين من بغداد وهم حيدر حمزوز و دينا نجم الدين . 

وكانت الحملة تحمل عنوان " دمك ودمي .. راح ينطي حياة للي مثلك وللي مثلي " . 

حيث اجتمع الشباب المتبرعين من كلا الجنسين في الكرادة مقابل موقع التفجير ( هيئة النزاهة ) الذي حصل قبل عدة ايام متوجهين الى مستشفى مدينة الطب ( مصرف الدم ) وذلك ليكون دليلاً للارهابيين ان العراقيين اقوى من ان تخيفهم او تفرقهم هذه التفجيرات .

أود في البداية أن أتوجه بالشكر والامتنان إلى جميع من تعاطف معي وساندني من الأهل والأصدقاء والمحامين والشخصيات الدينية والسياسية وأفراد المجتمع، والمنظمات في داخل البحرين وخارجها
وأتوجه بهذا الخطاب إلى كل من يعنيه الأمر، بغرض استعراض تطورات القضية التي أنا موقوف من أجلها منذ 25 سبتمبر الماضي. حيث سأحاول تقييم الأبعاد القانونية والحقوقية للقضية، وبناءً على ذلك سأبين موقفي بشأنها .

 أولاً : فيما يتصل بموضوع التهمة وطريقة تحريك الدعوى القضائية، فبالرغم من أن الحكومة قد جندت نفوذها في مؤسسات الدولة والمجتمع وفي وسائل الإعلام لاتهامي وإدانتي أمام الرأي العام ب"الشتم" و"الإساءة" و"التجريح" بحق شخص أو أشخاصآخرين، وهي تهمة إن صحت فتقتضي أن يتقدم المتضرر بشكوى قضائية بعنوان القذف ليتم التقاضي على أساس جنائي صرف. إلا أن الحكومة _ بدلاً من ذلك_ اختارت تحريك القضية عبر النيابة بتهمة ذات طابع سياسي، تمثل موضوعها في نعت الحكومة ورئيسها بالفساد وإهدار الأموال العامة، وهو ما يجعل القضية ذات ارتباط مباشر بحرية التعبير عن الرأي .

ثانياً : لجأت الحكومة إلى استخدام النيابة العامة كذراع قضائي لهافقد استفادت من قانون الإجراءات الجنائية الذي شرعته بنفسها عام 2002. وهو قانون يصف النيابة بأنها جزء من القضاء إلا أنه يضعها من الناحية الإجرائية بيد الحكومةمما يمكن الحكومة من إساءة الاستفادة من الصلاحيات المبالغ في سعتها في الضبط والاتهام وإجراءات التقاضي. وقد شاهدنا في هذه القضية كيف تم استخدام تلك الصلاحيات في إصدار قرار الاعتقال، والإبقاء في الحبس الاحتياطي لمدة طويلة دون ضرورةقانونية. ثم كيف تم تشكيل الاتهامات بخلفية سياسية. أما المرافعة المكتوبة والتي تقدم بها رئيس النيابة إلى المحكمة فإنها لم تبق أية فرصة للنيابة لإدعاء النزاهة والاستقلالية عن الحكومة، فقد جاءت  لغة المرافعة معبأة بالتحامل المبالغ فيه ضد المتهم، والدفاع عن الحكومة ورئيسها بخطاب عاطفي بعيد عن المنطق ولغة القانون .

ثالثاً : نظراً لعدم وجود شكوى شخصية بالقذف، أي عدم وجود قضية جنائية يتم التقاضي الاعتيادي على أساسها، فلم تجد الحكومة أمامها سوى الاستعانة بمواد أمن الدولة من قانون العقوبات والذي شرعته بنفسها في حقبة أمن الدولة لتتمكن من تقييد الحريات وتجريم المخالفين لها. وهي مواد طالما انتقدتها هيئات الأمم المتحدة المختصة ومنظمات حقوق الإنسان الدولية، باعتبار أن هذه المواد فضفاضة ويمكن استخدامها لانتهاك حقوق الإنسان ومصادرة الحريات. وقد أضيف إلى ذلك ما قام بهالأساتذة المحامين الذين تطوعوا في قضيتي هذه من تقديم مذكرة رصينة تطعن في المادة 165 من قانون العقوبات بأنها تتعارض مع حرية التعبير التي نص عليها الدستور. وهذه المادة نموذج لما يحتوي عليه القانون المذكور .

رابعاً : باعتبار أن القضاء بشكل عام لا يزال يعاني من نفوذ الإدارة التنفيذية، وخصوصاً فيما يتعلق بالقضايا ذات الطابع السياسي، لذلك لم يكن مفاجئاً استمرار المحكمة في تمديد الحبس الاحتياطي مرة بعد أخرى رغم انتقاء الضرورة القانونية. كما لم يكن مفاجئاً مسارعة قاضي المحكمة للدفاع عن مشروعية قانون العقوبات وسلامته القانونية رداً على قول المتهم بأن القانون غير دستوري حيث صدر في غياب البرلمان في حقبة أمن الدولة.

 بناءً على ما تقدم: فإن هذه القضية قد افتقدت للأساس القانوني السليم، وجانبت النزاهة والحياد ومقتضيات العدالة، سواءً في الإجراءات أو القوانينوإن ما يسمى بالمحاكمة ليس سوى محاكمة أمن الدولة تم عقدها بدوافع سياسية وبغرض تجريم انتقاد السلطة واتهامها بالفساد. ولا يوجد أي دليل بأن نتائج هذه "المحاكمةستكون منفصلة عن مقدماتها أو مغايرة لطبيعتها. لذلك.. فإن التعاطي مع هذه المحاكمة سيمنحها معنوياً الشرعية التي تفتقدها، وإن القبول بإجراءاتها وقراراتها يؤسس لسابقة خطيرة في العهد الجديد، حيث تصبح محاكمات أمن الدولة سيفاً مسلطاً تستخدمه الحكومة حين وكيف تشاء لتقييد الحريات والمعاقبة على ممارستها. ولذلك.. فقد وجدت من الضروري أن أمتنع عن حضور جلسات هذه المحاكمة ، وأن لا أضع أي اعتبار لمجرياتها وقراراتها. ويصبح من الواضح الآن.. بأن هذه القضية من ناحية الموضوع هي احتجاز تعسفي وانتهاك لحرية التعبير. وان أي قرار يصدر عن المحاكمة المذكورة لن يغير من صفة وموضوع القضية. وقد جاء في قرار فريق الأمم المتحدة المختص بالاحتجاز التعسفي في قراره الصادر عام 1996 بشأن المحكومين من قبل محكمة أمن الدولة البحرينية بأن تقييد الحرية الناشئ عن محاكمة مبنية على إجراءات وقوانين غير عادلة، يعتبر احتجازاً تعسفياً يلزم وضع حد له، والتعويض عن أضراره ؟
وإنني أرى بأن مجريات هذه القضية تصلح نموذجاً وعبرة ودافعها لإصلاح القوانين المتعلقة بالحريات وتحقيق استقلالية القضاء والحد من أهمية السلطة التنفيذية على مؤسسات الدولة والمجتمع ووسائل الإعلام .

وختاماً : فإنني أطلب من المحامين الأعزاء، وجميع المتعاطفين معي في هذه القضية، أن يتجاهلوا هذه المحاكمة الصورية ويقاطعوا جلساتها ويعتبروا كأنها لم تكن
 وأطالب السلطات بإطلاق سراحي فوراً ودون قيد أو شرط، مع ضمان حقي كأي فرد آخر في التعبير عن رأيي في الشؤون العامة للبلد، ومن ذلك ما يتعلق بأداء الحكومة الذي يتسم بالفساد الإداري والمالي وإهدار الأموال العامة، خصوصاً لأن ذلك يعد سبباً رئيسياً لانتهاك الحقوق الاقتصادية والاجتماعية وانتشار الفقر وتدني مستويات المعيشة .


 أما القول بأن موقفي هذا قد يؤدي إلى تشدد الحكومة في القضية وإبقائي في السجن لفترة أطول، فإني لا أملك إزاء ذلك سوى أن أردد ما جاء في القرآن الكريم على لسان يوسف (عليه السلام): "قال رب السجن أحب إلى مما يدعونني إليه .

Alaa Abd El Fattah



is an Egyptian blogger, software developer, and political activist. He is known for co-founding (along with his wife Manal) the Egyptian blog aggregator "Manalaa" and "Omraneya", the first Arab blog aggregators that did not restrict inclusion based on the content of the blog. In 2005 his blog won the Special Reporters Without Borders Award in Deutsche Welle's Best of Blogs competition. He has been active in developing Arabic-language versions of important software and platforms.

Background
El Fattah grew up in a family of activists and activism was a constant topic of discussion in his childhood. His father, Ahmed Seif El-Islam Hamad, a human rights attorney who had been arrested in 1983 by State Security Investigations Service officers and tortured and imprisoned for five years, is one of the founders of the Hisham Mubarak Law Center. His mother Laila Soueif, sister of Ahdaf Soueif, is a professor of mathematics at Cairo University and a political activist. His parents' activism dates to the days of Anwar Sadat During a demonstration in 2005 his mother, along with other women, were attacked by Mubarak supporters; El Fattah was said to have protected her.

May 2006 arrest and reaction
On 7 May 2006, he was arrested during a peaceful protest after he called for an independent judiciary. His arrest, along with that of several other bloggers and activists, spurred solidarity protests by others around the world, some of whom created the blog "Free Alaa" devoted to calling for his release from jail. El Fattah was released on 20 June 2006, after spending 45 days in jail. His wife Manal was quoted by the The Independent as saying There's no going back now, we'll definitely be continuing our activities .

2011 revolution
Abd El Fattah was out of Egypt on the 25th of January 2011, when the government shut down the internet in the country; he was able to collect information from family and friends by land-line phones and published to the world what was happening in Egypt during the first days of the revolution[citation needed].
A few days later he was in Egypt, and was in Tahrir square in 2nd of February, participated in defending the square against the military and mobs attack, known as Egypt's Camel battle.
Continued his participation in the Egyptian revolution, till the fall of president Mubarak, and after that he returned to live in Egypt, when he again participated in the demonstrations against the SCAF (Supreme Council of Armed Forces) way of running the country.
On October 30, El Fattah was arrested on charges of inciting violence against the military during the October 9 Maspero demonstrations, during which hundreds of people were injured and 27 died in the worst violence since Mubarak left office. El Fattah refused to recognise the legitimacy of his interrogators or answer their questions and was then to be held for 15 days, a period that could be indefinitely renewed by authorities. He is accused of having incited fighting in Maspero, of assaulting soldiers and damaging military property. As in his 2006 imprisonment, his mother has spoken out in his support, and initiated a hunger strike in opposition to the court-martialling of civilians on November 6th. His father and sisters also participated in the 2011 protests.. His sister Mona Seif is a founding member of the 'No Military Trials for Civilians', a group raising awareness for the civilian detainees summoned by military prosecutors and investigating torture allegations involving military police.
The UN Commission for Human Rights has called for the release of Abd El Fattah and all others imprisoned for exercising free speech .

مدونوا العراق يتضامنون مع المدونون العرب المعتقلين








تضامن المدونين العراقيين مع المدونين العرب المعتقلين 



اعلن المدونين العراقيين تضامنهم مع المدونين العرب المعتقلين علاء عبد الفتاح من مصر و رزان غزاوي من سوريا ومن البحرين عبد الهادي الخواجة والمدون علي عبد الامام الذي اطلق سراحه ولكن لايزال مختفياً دون ان يمارس نشاطاته نتيجة الضغوط التي تعرضها لها .
كما ناقش المدونين العراقيين خلال الجلسة التي اقيمت في محافظة الديوانية مساء يوم الخميس المصادف الثامن من كانون الاول كيفية النهوض والتقدم في مجل التدوين خصوصاً و الصحافة عموماً حيث منح لقب سفير المدونين العراقيين للاُستاذ حيدر حمزوز .
واضاف الصحفي و المدون الاستاذ تحسين الزركاني ان مدونين محافظة الديوانية قد تمكنوا من في فترة قصيرة من تسجيل حضورهم مع باقي المدونين من المحافظات الشمالية والجنوبية ومحافظات الوسط وبين الاستاذ تحسين واجاد بالدور الذي مثله سفير المدونين حمزوز في المحافل العربية والدولية .
واضاف حمزوز ان التكنولوجيا اليوم قد قصرت المسافات حيث امن اتصال من محافظة كركوك واللقاء مع مدوني المحافظة عبر اتصال هاتفي للآظلاع على ماجرى من احداث خلال الاجتماع للتواصل مع مدوني الديوانية .

مــعــركــة الطــــف












معركة كربلاء وتسمى أيضاً واقعة الطف هي ملحمة وقعت على ثلاثة أيام وختمت في 10 محرم سنة 61 للهجرة والذي يوافق 12 أكتوبر 680م وكانت بينالحسين بن علي بن أبي طالب ابن بنت نبي الإسلام، محمد بن عبد الله، الذي أصبح المسلمون يطلقون عليه لقب "سيد الشهداء" بعد انتهاء المعركة، ومعه أهل بيته وأصحابه، وجيش تابع ليزيد بن معاوية .
تعتبر واقعة الطف من أكثر المعارك جدلاً في التاريخ الإسلامي فقد كان لنتائج وتفاصيل المعركة آثار سياسية ونفسية وعقائدية لا تزال موضع جدل إلى الفترة المعاصرة، حيث تعتبر هذه المعركة أبرز حادثة من بين سلسلة من الوقائع التي كان لها دور محوري في صياغة طبيعة العلاقة بين السنة والشيعة عبر التاريخ وأصبحت معركة كربلاء وتفاصيلها الدقيقة رمزا للشيعة ومن أهم مرتكزاتهم الثقافية وأصبح يوم 10 محرم أو يوم عاشوراء، يوم وقوع المعركة، رمزاً من قبل الشيعة "لثورة المظلوم على الظالم ويوم انتصار الدم على السيف .
رغم قلة أهمية هذه المعركة من الناحية العسكرية حيث إعتبرها البعض من محاولة تمرّد فاشلة قام بها الحسين إلا أن هذه المعركة تركت آثاراً سياسية وفكرية ودينيةهامة. حيث أصبح شعار "يا لثارات الحسين" عاملاً مركزياً في تبلور الثقافة الشيعية وأصبحت المعركة وتفاصيلها ونتائجها تمثل قيمة روحانية ذات معاني كبيرة لدى الشيعة الذين يعتبرون معركة كربلاء ثورة سياسية ضد الظلم. بينما أصبح مدفن الحسـين في كربلاء مكاناً مقدساً لدى الشيعة يزوره مؤمنوهم، مع ما يرافق ذلك من ترديد لأدعية خاصة أثناء كل زيارة لقبره. أدى مقتل الحسين إلى نشوء سلسلة من المؤلفات الدينية والخطب والوعظ والأدعية الخاصة التي لها علاقة بحادثة مقتله وألفت عشرات المؤلفات لوصف حادثة مقتله .

Iraqi bloggers and social media activists speak up for their country

The 27-year-old Sahab gives a long laugh:  “The Iraqi government doesn’t bother me when I publish news and facts about the situation in Iraq in my blog.”
“I write under a pseudonym so no one knows my real identity,” he says, explaining this choice: “If the government finds out who I am, it will start to follow me and restrict me.”
Sahab’s smile is filled with hope when he adds:  “I know it’s dangerous to write but it’s important to document the suffering of the people and help them by letting others know the truth. I don’t want the crimes that happened in my country to be forgotten.”
Sahab launched his blog Shelters of death in March 2008. “I receive 50 visitors per day and a lot of comments,” he says.
The media landscape in Iraq, strictly controlled under the dictatorial rule of Saddam Hussein, started recovering and opening up after his fall from power in 2003, with the gradual establishment of 52 radio stations, 47 televisions stations and 160 newspapers and an increasing activity in the blogosphere and social media networks.

Blog or Facebook?

Nevertheless, although Iraq now describes itself as a democratic country, many bloggers express concern that they are being monitored by government agencies.
Rusul Kamel, a 24-year old Iraqi activist and blogger writes human rights issues in the capital Baghdad: “I write everything in my blog, but I’m afraid to criticise the government because I have heard of many arrests among bloggers and I’ve been told of the government’s control of all that is published. I do not know how truthful this information is but to be on the safe side sometimes I publish my writing on my Facebook page because I trust that my friends will not betray me.”
Kamel started blogging in 2010 after meeting a group of young people who introduced her to the practice. “My blog is the place to express myself and circle all the concerns that I’ve been having and that many young people like me are facing,” she says.
“Every citizen is an observer,” she continues.” When my attention is drawn to a particular issue, I write about it in order to rally public opinion. A journalist can also be a blogger. I find that many journalists keep private blogs, because blogging gives the freedom to write without being restricted by media organisations’ rules.”

BAGHDAD — Blog by blog and tweet by tweet, tech-savvy Iraqis are trying to reproduce the revolutions of the Arab Spring on a subtler, more incremental level: by encouraging activism, reporting news, holding officials accountable and creating a broadband society that is not beholden to checkpoints, car bombs and other obstacles in the non-virtual world of Iraq.

"I believe Libya had success because they had social media to help their revolution - we didn't," said a 23-year-old blogger and activist who goes by the name Hayder Hamzoz. "We didn't have enough connectivity to the outside world in 2003."
Hayder Hamzoz is one of the forces behind the blog Iraqi Streets, which has 30 regular contributors and aims to promote activism and social media while teaching young people how to leverage both. Last month, he and a fellow blogger who goes by Dina Najem, 22, sat in a cafe in Baghdad, having just returned from a social-media conference in Beirut.

The U.S. invasion opened Iraq to the free societies of the outside world, Hamzoz and Najem said, but it also installed a hamstrung political system that has obstructed the path to emulating those societies.

The number of Facebook users in the country has more than doubled since February, according to the social media statistics portal Socialbakers, but the Iraqi parliament is considering an "Informatics Crimes Law" that would, according to the British human rights organization Article 19, "significantly undermine the right to freedom of expression and freedom of information in the country" and impose "severe custodial and financial penalties on 'whoever violates principles, religious, moral, family, or social values . . . through information networks or computers.' "

"The government of Iraq is following the same theories of the former regime but in different manners," said Najem, who trains women how to use the Internet and social media through the nonprofit Iraqi al-Amal Association.

Najem, Hamzoz and their fellow bloggers are focused on the basics right now: preparing a safety and privacy guide for activists, using Twitter to amplify dispatches from hard-to-reach protests, transmitting media from closed social sites (such as Facebook) to publicly searchable platforms (such as Google), and helping provincial council members start Facebook pages to engage with young constituents.

The next challenge is to "turn these online activities into action in the streets," Hamzoz said. "But we don't have a future yet, just the present. So we do what we can now, with these tools."

كاتب مصري يؤكد أن تقسيم العراق فكرة صهيونية عمرها نصف قرن










 كشف كاتب مصري أن تقسيم العراق ليس فقط له صلة بالغزو الأمريكي للعراق عام 2003، وإنما أساس هذه الفكرة يعود إلى ما يزيد عن خمسين سنة.
وقال أحمد سعيد تاج الدين مؤلف الكتاب الذي حمل اسم " محنة أمة: ماذا جرى في العراق": "تقسيم العراق فكرة ليست جديدة بل طرحت منذ عام 1957 حين نشر الصحفي الهندي كرانجيا كتابا بعنوان "خنجر إسرائيل" وتضمن وثيقة سرية "إسرائيلية" عن خطة عسكرية تهدف لإقامة "إسرائيل" الكبرى من نهر النيل إلى الفرات، وتقضي الخطة بتقسيم سوريا إلى ثلاث دويلات درزية وعلوية وعربية سنية، وتقسيم لبنان إلى دولتين مارونية وشيعية".
وأضاف مؤلف الكتاب: "فكرة تقسيم العراق كما سجلها الكاتب الهندي تشمل تقسيمه إلى "دولة كردية في الشمال ودولة عربية في الوسط وإلحاق المنطقة الجنوبية بشاه إيران محمد رضا بهلوي حليف أمريكا آنذاك، وذلك لتحقيق هدفين هما مكافأة الشاه وخلق خلل في منطقة الخليج لخدمة الأهداف الإستراتيجية الإسرائيلية والأمريكية".

2003 invasion of Iraq













The 2003 invasion of Iraq (March 19–May 1, 2003), was the start of the conflict known as the Iraq War or Operation Iraqi Freedom in which a combined force of troops from the United States, the United Kingdom, Australia and Poland invaded Iraq and toppled the regime of Saddam Hussein in 21 days of major combat operations. The invasion phase consisted of a conventionally fought war which concluded with the capture of the Iraq capital Baghdad by United States forces.
Four countries participated with troops during the initial invasion phase, which lasted from March 19 to April 9, 2003. These were the United States (148,000), United Kingdom (45,000), Australia (2,000), and Poland (194).  other countries were involved in its aftermath. In preparation for the invasion, 100,000 U.S. troops were assembled in Kuwait by February 18 The United States supplied the majority of the invading forces, but also received support from Kurdish irregulars in Iraqi Kurdistan.
According to U.S. President George W. Bush and British Prime Minister Tony Blair, the reasons for the invasion were "to disarm Iraq of weapons of mass destruction, to end Saddam Hussein's alleged support for terrorism, and to free the Iraqi people."However, former chief counter-terrorism adviser on the National Security Council Richard A. Clarke believes Mr. Bush came into office with a plan to invade Iraq. According to Blair, the trigger was Iraq's failure to take a "final opportunity" to disarm itself of nuclear, chemical, and biological weapons that U.S. and British officials called an immediate and intolerable threat to world peace. In 2005, the Central Intelligence Agency released a report saying that no weapons of mass destruction had been found in Iraq.
In a January 2003 CBS poll 64% of U.S. nationals had approved of military action against Iraq, however 63% wanted Bush to find a diplomatic solution rather than go to war, and 62% believed the threat of terrorism directed against the U.S. would increase due to war. The invasion of Iraq was strongly opposed by some traditional U.S. allies, including the governments of France,Germany, New Zealand, and Canada. Their leaders argued that there was no evidence of weapons of mass destruction in Iraq and that invading the country was not justified in the context of UNMOVIC's February 12, 2003 report. On February 15, 2003, a month before the invasion, there were worldwide protests against the Iraq war, including a rally of three million people in Rome, which is listed in the Guinness Book of Records as the largest ever anti-war rally. According to the French academicDominique Reynié, between January 3 and April 12, 2003, 36 million people across the globe took part in almost 3,000 protests against the Iraq war.
The invasion was preceded by an air strike on the Presidential Palace in Baghdad on March 19, 2003. The following day coalition forces launched an incursion into Basra Province from their massing point close to the Iraqi-Kuwaiti border. While the special forces launched an amphibious assault from the Persian Gulf to secure Basra and the surrounding petroleum fields, the main invasion army moved into southern Iraq, occupying the region and engaging in the Battle of Nasiriyah on March 23. Massive air strikes across the country and against Iraqi command and control threw the defending army into chaos and prevented an effective resistance. On March 26 the 173rd Airborne Brigade was airdropped near the northern city of Kirkuk where they joined forces with Kurdish rebels and fought several actions against the Iraqi army to secure the northern part of the country.
The main body of coalition forces continued their drive into the heart of Iraq and met with little resistance. Most of the Iraqi military was quickly defeated and Baghdad was occupied on April 9. Other operations occurred against pockets of the Iraqi army including the capture and occupation of Kirkuk on April 10, and the attack and capture of Tikrit on April 15. Iraqi President Saddam Hussein and the central leadership went into hiding as the coalition forces completed the occupation of the country. On May 1 an end of major combat operations was declared, ending the invasion period and beginning the military occupation period.
